PRIVACY NOTICE ON THE PROCESSING OF PERSONAL DATA

Article 13 of Regulation (EU) 2016/679

 

Pursuant to Article 13 of Regulation (EU) 2016/679 (“GDPR”), laying down provisions for the protection of natural persons with regard to the processing of personal data, we hereby inform you that the personal data you provide will be processed in compliance with the above-mentioned legislation and in accordance with the principles of lawfulness, fairness, transparency, and the protection of your confidentiality and your rights.

To this end, in fulfilment of the requirements set forth in Article 13, we provide you with the following information regarding the processing of your personal data:

DATA CONTROLLER

The companies Emak S.p.A., Sabart S.r.l., Comet S.p.A., Lavorwash S.p.A., PTC S.r.l., Tecomec S.r.l., PNR Italia S.r.l. and Poli S.r.l. have appointed a Group Data Protection Officer who, with regard to the processing activities carried out through this platform, may be contacted at the following e-mail address: dpo@emak.it.

The contact details of the Data Protection Officers of the other Group companies may be found on their respective websites.

In essence, the recruiting platform is operationally managed by Emak S.p.A., which acts as Data Controller together with the other companies to which the data subject submits their application. Please note that any application submitted, whether for a specific position or as a spontaneous application, may also be considered and evaluated for professional opportunities within one or more companies of the Group, in line with your profile and skills.

Curricula and the information provided will be accessed exclusively by authorised personnel of the Human Resources departments of the Group companies, and will be used solely for staff selection and evaluation purposes.

The operational management of the platform is entrusted to Emak S.p.A., to which any requests for the exercise of rights pursuant to Articles 15–22 of the GDPR, with reference to personal data processing carried out through this platform, may be addressed.

Requests relating to specific personnel selection activities must instead be directed to the individual Group companies involved in the relevant recruitment process.

The companies indicated above with an asterisk have appointed a Group Data Protection Officer who, with regard to the processing activities carried out through this platform, may be contacted at the following e-mail address: dpo@emak.it.

PURPOSES AND LEGAL BASIS OF PROCESSING

Personal data may be processed for purposes related to the assessment of aptitudes and professional skills, for the possible establishment of an employment relationship with companies of the Emak Group. Please note that the selection process may include participation in interviews and/or tests, either in person or online.

For this purpose, processing is necessary for the performance of the recruitment process and, more generally, for the implementation of pre-contractual measures related to the management of your professional relationship, pursuant to Article 6(1)(b) of the GDPR.

Personal data may also be processed where necessary to comply with obligations arising from legal provisions in civil and tax matters, EU legislation, as well as rules, codes or procedures approved by competent authorities and other institutions.

Furthermore, personal data may be processed in order to respond to requests from the competent administrative or judicial authority and, more generally, from public entities, in compliance with legal formalities.

For this purpose, processing is necessary to fulfil legal obligations pursuant to Article 6(1)(c) of the GDPR.

Recruitment documentation may be shared with other companies of the corporate Group in order to establish an employment or collaboration relationship. The data processed for this purpose will be those actually collected during the personnel search and selection phases.

For this purpose, the legal basis is the legitimate interest pursuant to Article 6(1)(f) of the GDPR, consisting in the need to manage recruitment processes within the Group in a coordinated and efficient manner, facilitating the matching of professional profiles with available positions, without prejudice to the fundamental rights and freedoms of the data subjects.

 

SPECIAL CATEGORIES OF PERSONAL DATA

In addition to identification, contact and professional data necessary for registration on the portal and for applying for job offers, it may happen that, in the context of receiving and managing CVs, the Group companies may become aware of data that the GDPR defines as “special categories of personal data”, in particular information revealing your health status (e.g. belonging to protected categories under Law 68/99, any disability, etc.).

We kindly ask you not to include in your CV other special data (religious or philosophical beliefs, political opinions, membership in parties or trade unions, sexual orientation) whose processing is not necessary for the selection process and which will be deleted, where reasonably possible.

 

PROCESSING METHODS

Personal data may also be processed with the aid of electronic or automated means, managed through tools suitable to ensure security and confidentiality, and will include any operation or set of operations necessary for such processing.

RECIPIENTS OF PERSONAL DATA

Your Personal Data may be shared with the following persons/entities (“Recipients”):

Persons, companies or professional firms providing the Emak Group with consultancy and assistance in accounting, administrative, legal, tax and financial matters, or debt collection, typically acting as data processors on behalf of the Group companies;

Entities engaged in IT activities (e.g. hosting providers or email platform providers) and authorised to carry out technical maintenance activities;

Persons authorised by the Emak Group companies to process Personal Data necessary for the performance of activities, who have undertaken confidentiality obligations or are subject to an adequate legal duty of confidentiality;

Other Emak Group companies for the purpose of establishing an employment or collaboration relationship on the basis of legitimate interest;

Public bodies, organisations or authorities for compliance, abuse or fraud purposes, or binding orders by authorities.

TRANSFERS OF PERSONAL DATA

Given the international presence of the Emak Group, some of your Personal Data may be transferred to Recipients located in different countries. Where required by applicable Data Protection Legislation, appropriate safeguards are adopted to ensure the lawfulness and security of such transfers, for example through adequacy decisions by the European Commission, standard contractual clauses adopted by the European Commission, or other safeguards deemed appropriate.

RETENTION OF PERSONAL DATA

Personal Data processed for recruitment purposes will be retained for the time strictly necessary to achieve the purposes described above and, in any case, for a maximum of 24 (twenty-four) months from registration on the portal.

Within 7 (seven) days prior to the expiry of this period, you may request an extension or update of the retention period. In the absence of a response, the collected Personal Data will be deleted.

 

RIGHTS OF DATA SUBJECTS

Where applicable and within the limits of the GDPR, data subjects have the right to:

obtain confirmation as to whether personal data concerning them are being processed and, if so, access the information under Article 15 GDPR;

obtain rectification of inaccurate personal data or completion of incomplete data pursuant to Article 16 GDPR;

obtain erasure of personal data where one of the grounds under Article 17 GDPR applies;

obtain restriction of processing in the cases provided for by Article 18 GDPR;

receive personal data in a structured, commonly used and machine-readable format and transmit those data to another controller pursuant to Article 20 GDPR;

object to processing for specific reasons unless compelling legitimate grounds override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims pursuant to Article 21 GDPR;

withdraw consent given.

The operational management of the platform is entrusted to Emak S.p.A., to which requests for the exercise of rights under Articles 15–22 of the GDPR may be addressed.

COOKIES

This website does not use analytics or profiling cookies.

Only navigation or session cookies are present, which ensure the normal navigation and use of the Website.

These cookies are installed directly by the Data Controller and are used, pursuant to Article 6(1)(f) of the GDPR, to facilitate navigation and, pursuant to Article 6(1)(b) of the GDPR, to provide the services requested by the user.
